1 - RESPONSIBILITIES OF HIRER

The Hirer accepts full responsibility for loss or damage to the Plant and will be responsible for the full replacement cost of items lost, stolen or damaged beyond repair. The Hirer shall permit access for the purpose of inspection, testing and maintenance to all Plant on hire. In placing this order, you confirm that the Plant quoted (with specification sheets provided) are suitable for application, to the best of your knowledge.

 The security of any Plant remains your responsibility until it is collected by us or has been returned.

 

2 - DELIVERY IN GOOD ORDER

The Hirer must be satisfied that the Plant is in good working order and not damaged in any way before signing the delivery note, and the Hirer acknowledges that LGH relies on the Hirer to inspect the Plant immediately after delivery to ensure that it is of satisfactory quality and fit for its purpose.

The Hirer shall be responsible for loading or unloading the Plant on site and for the provision of any lifting facilities required for loading or unloading on site. Test certificates are available for all items and will be issued with the delivery note; copies of examination reports are available on request.

 

3 - ON HIRE, OFF HIRE, AND CHARGING

The Plant is considered to be on hire when it is delivered to the Hirer and until it is collected from the Hirer.  Should the Hirer arrange transit to and from LGH premises, then the Plant is deemed to be on hire at the time of leaving the LGH premises to the time of being returned and off-loaded back at the premises.

Minimum chargeable hire period is 1 week (Monday to Friday). Hires exceeding one week are charged on the number of additional days required, and charged at 1/5 of the weekly hire rate for each additional day and the full weekly rate for hires exceeding five additional days.  Off hire of Plant MUST be requested in writing (via email) and will be confirmed with written receipt of an ‘off hire’ number.

If, for any reason, you wish to request a Stand Down or Hire Suspension, this must be requested via email to info-nl@lgh.eu at least 3 days prior to commencement of stand down/suspension. LGH will strive to accommodate the request and respond with a decision within 1 day. We will not apply a Stand Down or Hire Suspension within the first 7 days of hire (This includes Bank Holidays).

 

4 – DELIVERY AND COLLECTION OF PLANT

The Plant will be delivered between the hours of 10:00 & 17:00 GMT. Deliveries which are required to arrive on site prior to 10am may be arranged, but will be charged at a premium rate.

If there are any restrictions to the delivery and collection of the Plant (specific site opening times, PPE requirements or Logistics/site access forms required prior to arrival) it is the responsibility of the hirer to provide this information within a reasonable time prior to the delivery/collection date.

In placing this order, the hirer confirms that the delivery address provided is accurate (where the site does not have a delivery postcode, “What-3-Words” has been provided). Failed delivery charges will be applicable if the site cannot be located and/or the site contact cannot be contacted using the details.

 

Waiting charge: £25 per 15 minutes (charges begin after first 15 minutes)

Failed delivery charge: FULL delivery and collection charges will apply.

Order cancellation: Orders cancelled on the scheduled delivery date shall be charged at the FULL delivery and collection fees, plus 1 days hire of the equipment.

 

5 - MAINTENANCE AND SAFE USE OF PLANT

The Hirer shall be responsible for the safe-keeping, maintenance and correct use of all Plant on hire. Plant should be used in line with the manufacturer’s rated capacity and returned in good working order (fair wear and tear excepted). The Hirer shall be responsible for compliance with all laws and regulations applicable to the Plant and to the work being performed by the Plant. The Hirer shall regularly clean the Plant and return it in a clean condition.

All damages to Plant (except fair wear and tear) shall be chargeable. This may include (and is not limited to) parts, labour and loss of revenue.

Lost Plant shall be charged at the “full rate of replacement Plant” and loss of revenue during replacement period.

 

6 - BREAKDOWN

Any breakdown or unsatisfactory working of any Plant must be notified to LGH immediately and the Hirer must wait for guidance or assistance. Under no circumstances shall the Hirer repair or attempt to repair the Plant themselves.

 

7 - NOTICE OF ACCIDENTS 

If the Plant is involved in any accident resulting in injury to persons or damage to property, immediate notice must be given to LGH and confirmed in writing to the LGH registered office: 120 Bolton Road, Atherton, Manchester, M46 9JZ.

 

8 - GENERAL

Any variation to these conditions and any representation about the Plant shall have no effect unless it is expressly agreed in writing by LGH. The Hirer must ensure that the terms of its order and any applicable specification are accurate, must notify LGH if the order or specification requires any unusual procedure to be carried out and must answer all questions reasonably in relation to any order and any applicable specification.

Payment becomes due 30 days from the date of the invoice, unless a written agreement is signed on behalf of LGH confirming a variation to the payment period. If payment is not made by the due date, LGH has the right to charge interest and reasonable debt recovery costs. No payment shall be deemed to have been received until LGH has received cleared funds into its account.

All invoice queries MUST be submitted to info-nl@lgh.eu within 14 days of the invoice date. Queries submitted after this time may be rejected.
